Iraqi Daughter Faces Trial Over Allegations of Forced Fleeing and Potential Rape - Alleged Sexual Assault of a Daughter During Flight from Iraq

The unsettling trial of a 79-year-old man, living in Frankfurt, has commenced at the Frankfurt Regional Court. The man is accused of repeatedly raping his own daughter during their perilous escape from Iraq in the 1990s. In the chilling indictment, the prosecutor alleged, "She was helpless against him."

The defendant, wheelchair-bound and silent, remained undefended by his lawyer, who presented a medical certificate indicating that the man's deteriorating health, including advancements in dementia, render him unfit to stand trial. The prosecution will assess the man's fitness for trial before the next hearing.

The family's escape from Iraq stemmed from political circumstances, with the father and daughter becoming separated along their arduous journey. Their first harrowing encounter occurred in a Lithuanian refugee camp's primitive latrine, where, according to the indictment, the man raped his daughter for the first time, threatening her life if she dared to reveal the truth.

A series of horrific acts

The prosecutor detailed a chilling sequence of nine separate alleged sexual assaults committed against the daughter, which occurred in a forest in Armenia, a smuggler's apartment, and on a rowboat in Kazakhstan. Sometimes, the sexual assaults were accompanied by brutal beatings, despite the woman's fierce resistance. On the rowboat, the defendant reportedly threatened to throw the young woman into the water, despite her immense fear of drowning and inability to swim. The assaults stopped only after the family was reunited in Germany in 1997.

  1. The community policy regarding the protection of victims and witnesses in criminal trials should provide appropriate measures to safeguard the daughter's wellbeing and ensure a fair trial, considering the sensitive nature of the case.
  2. In light of the allegations, the employment policy of health-and-wellness organizations should emphasize awareness and training programs to address issues of sexual health and support for victims of sexual violence.
  3. General news outlets should exercise sensitivity and responsibility when reporting on the trial, ensuring that the victim's privacy and dignity are fully respected while promoting awareness about the consequences of crime-and-justice issues, particularly those involving familial relationships.
