Clinics in NRW voicing discontent over the recent reforms - Complaints lodged by two clinics against the reform implemented in NRW
In a significant development, two clinics in the Rhineland, Neuss and Moers, have successfully challenged the Düsseldorf Regional Government's hospital reform. The North Rhine-Westphalia Higher Administrative Court (OVG) has allowed these clinics to continue providing and billing their republic services, contrary to the initial proceedings at the Düsseldorf Administrative Court.
The OVG's decision comes amidst disputes regarding supply contracts in the hospital reform in North Rhine-Westphalia. The court has criticised the lack of a sound need analysis and the state's failure to provide a sound calculation method or appropriate criteria in the case of the hospital services.
In the case of the Neuss clinic, leukemia and thoracic surgery are included in the services they can continue to provide. Similarly, the Moers clinic has been allowed to continue offering leukemia services. However, the OVG criticised errors in discretion in the selection decision against the plaintiff clinic in the case of thoracic surgery.
The OVG's decisions in this case are not appealable. It is worth noting that there are still 27 pending expedited proceedings at the OVG, involving complaints against the implementation of the NRW hospital plan in hospitals across the Rhineland, including Münster.
